2. Purpose of the Website
BankRepo.co.za helps participating property agents advertise to people who may be interested in property opportunities in their area.
The website does not act as an estate agency, bank, seller, auctioneer, conveyancer, attorney, or adviser.
The website does not guarantee that any specific property is available or that any property will be sold below market value.
3. No Affiliation
BankRepo.co.za is not owned by, endorsed by, or connected to any bank, financial institution, auction house, government body, sheriff, liquidator, property owner, or property portal unless this is clearly stated in writing.
4. Agent Responsibility
Agents are responsible for having lawful access to property information in their own area.
Agents are also responsible for checking availability, ownership, pricing, property condition, and all other details before giving information to consumers.
BankRepo.co.za does not check or approve property information supplied by agents.
5. Consumer Enquiries
When a consumer submits an enquiry, they are asking to be contacted by a participating agent about possible property opportunities.
Submitting an enquiry does not guarantee property availability, finance approval, discounted pricing, viewing appointments, or successful purchase.
6. Consumer Responsibilities
Consumers must provide accurate information, submit genuine enquiries only, and verify all property information before making decisions.
Consumers should obtain independent legal, financial, and property advice where needed.
7. Consent to Contact
By submitting details through the website, the consumer agrees to be contacted about their enquiry by BankRepo.co.za, participating agents, or related support providers.
Contact may take place by phone, email, SMS, WhatsApp, or online message. Consumers may opt out of marketing communication at any time.
8. Legal Compliance
Agents, agencies, advertisers, and users are responsible for complying with all applicable South African laws, including consumer protection, privacy, advertising, property practitioner, and electronic communication laws.
Agents must handle personal information lawfully, respect opt out requests, avoid misleading claims, and keep their own compliance records.
9. Advertising Rules
Agents are responsible for all advertising and claims made by them.
Agents may not use false, misleading, deceptive, exaggerated, or bait advertising. Agents must not claim that a property is available, discounted, distressed, or repossessed unless they have verified this.
We may remove or suspend adverts, campaigns, links, accounts, or content at our discretion.
10. Lead Usage
Leads may only be used to respond to the specific enquiry submitted by the consumer.
Agents may not sell leads, share leads unlawfully, add consumers to unrelated marketing lists without consent, or continue contacting consumers after an opt out request.
11. Fees and Subscriptions
Where paid services are offered, fees are payable in advance unless agreed otherwise. Failed payments may result in suspension.
Unless required by law, fees already paid are non refundable.
12. No Guarantee of Results
We do not guarantee enquiries, lead quality, property availability, sales, commission, advertising performance, or uninterrupted service.
The website is provided on an as available basis.
13. Prohibited Use
Users may not scrape data, reverse engineer the website, upload harmful code, misuse personal information, send spam, mislead consumers, interfere with the website, or use the website unlawfully.
14. Intellectual Property
All website branding, software, systems, content, and materials remain the property of BankRepo.co.za unless otherwise stated.
No content may be copied or distributed without permission.
15. Privacy
Personal information is handled according to our Privacy Policy.
Agents receiving lead information are independently responsible for handling that information lawfully and securely.
16. Third Party Information
Agents may use lawful third party sources to find or verify property opportunities.
BankRepo.co.za is not responsible for third party property data, listing accuracy, availability, system outages, or third party terms.
17. Suspension and Termination
We may suspend or terminate access if these Terms are breached, unlawful conduct is suspected, misleading advertising is used, or where required by law.
18. Limitation of Liability
To the maximum extent allowed by law, we are not liable for indirect damages, lost profits, lost business, agent conduct, property availability, property pricing, third party actions, or property transactions.
Where liability cannot legally be excluded, our total liability is limited to R1000.
19. Indemnity
Users agree to indemnify BankRepo.co.za against claims arising from misuse of the website, unlawful marketing, privacy breaches, consumer protection breaches, misleading advertising, false property claims, unlawful handling of personal information, or breach of these Terms.
20. Changes to Terms
We may update these Terms from time to time. Continued use of the website means acceptance of the updated Terms.
21. Governing Law
These Terms are governed by the laws of South Africa. Any disputes will be handled in South African courts.
